New Delhi: In the controversial, Pantheerankavu case, the Supreme Court of India has questioned the UAPA charges against Alan Shuhaib and Thaha Fazal over the alleged Maoist links.
The Supreme Court observed that mere support given to a terrorist organization or mere association with it, is not sufficient to attract offences under Sections 38 and 39 of the Unlawful Activities (Prevention) Act, 1967. The association and the support have to be with intention of furthering the activities of a terrorist organisation, the bench comprising Justices Ajay Rastogi and Abhay S. Oka observed.
The court asserted that UAPA will not be invoked against any person over alleged links with Maoist outfits.
The apex court granted bail to Thaha Fazal in its crucial verdict on Thursday. In the detailed verdict, the court has observed that UAPA charges will not exist against the duo.
