Living together partner not husband: Domestic violence cannot be alleged, High Court quashes case

Kochi: The High Court has stated that a partner in a live-in relationship cannot be called a husband. The Court emphasized that if one experiences physical and mental abuse from a partner or relatives in such relationships, it will not fall under the scope of domestic violence.

This ruling came after a young man from Ernakulam approached the High Court, pointing out the issue. He was in a live-in relationship with a young woman, and they lived together for a year. However, after their breakup, the woman lodged a complaint with the police alleging domestic violence. The Court made this critical observation while quashing the case.
The Court clarified that a person can only be called a husband if he is legally married. Those in live-in relationships are considered only as partners. Therefore, the High Court clarified that harassment in such relationships does not come under Section 498A of the IPC
