Kerala HC calls off Devikulam Assembly election result, disqualifies CPM MLA A Raja

Kochi: Kerala High Court cancelled the result of Assembly election 2021 at Devikulam constituency. The High Court observed that CPM MLA A Raja was not eligible to contest in the reserved seat and disqualified him.

The court said that A Raja does not belong to the Scheduled Caste/ Scheduled Tribe community. The court was hearing the petition filed by UDF candidate D Kumar. However, the court dismissed Kumar’s request to declare him the winner.

A Raja was disqualified after the court pointed out that he is from a converted Christian community. The petitioner accused Raja of producing fake caste certificate to contest the election.

He had won the Assembly polls 2021 from Devikulam constituency with a majority of 7,848 votes. With the disqualification of A Raja MLA, the strength of CPM members in the assembly shrinked from 99 to 98.

CPM and A Raja may file an appeal against the High Court judgement. As the assembly session is currently progressing, A Raja cannot continue in the assembly.
